Terms & Conditions for Employers

Standard Terms & conditions for employers using the Ravensbourne Agency website.

1. Definitions

Ravensbourne 
means Ravensbourne, 6 Penrose Way, Greenwich Peninsular, London, SE10 0EW;

Ravensbourne Agency
means the specialist, non-profit making, work placement, internship and opportunity service in the fields of art, design, fashion, media and communication provided Ravensbourne;

Student/graduate
means a student, recent graduate or alumni who is or was previously or currently enrolled as a student on a course provided by Ravensbourne;

Job-seeker
means an independent job seeker who uses the Ravensbourne Agency to look for work opportunities;

Employer
means a registered company, representative of a company, or individual who is using the Ravensbourne Agency to post work opportunity, placements or internships;

Recruitment Agency
means a company commissioned to advertise an opportunity or recruit employees on behalf of another company;

Website
Means Ravensbourne Agency and includes individual employers accounts  www.ravensbourne.ac.uk/agency administered and run by Ravensbourne;

User
means the employer who is using the Ravensbourne Agency to register work placements, internships or jwork opportunities. 

Opportunity/work opportunity
means either a work placement, internship or opportunity that a user wishes to advertise via Ravensbourne Agency.

2. Induction

2.1 The following general terms and conditions comprise the terms under which the User agrees to use the website, whether as a guest or registered user. By using the website, the user agrees to be bound by these Terms & Conditions, and agrees to the creation of a legally binding contract between the user and Ravensbourne.

2.2 Usual Terms & Conditions apply if the user is registered as a Recruitment Agency.

3.2.3 In the event of any conflict between any applicable additional terms and conditions and the general terms and conditions, the former shall prevail.

3. General Terms and conditions

3.1 Employer Registration

3.1.1 When an employer registers on the website, he or she must provide accurate, current and complete registration information. A valid email address must be provided and where possible, this should be a business email address.  The user must also update Ravensbourne with any changes to his or her registration information, including changes to any email addresses. When the user registers, he or she will be allocated password.  It is the user's responsibility to protect his or her user name and password from unauthorised use. The user must not disclose his or her user name or password to anyone else, or allow anyone else to use their user name or password, or assist anyone else who is not a registered user to access areas of the website which is restricted to registered users. The user must notify Ravensbourne immediately if he or she believes their password is known to someone else or if it has or may be used in an unauthorised way. Ravensbourne will not be liable for any unauthorised use that is made using the user's user name or password.

3.1.2 Ravensbourne reserves the right at its absolute discretion to refuse any request for registration, or to cancel any existing registration, for any reason whatsoever.

3.2 Submission of an opportunity

3.2.1 Any user wishing to advertise a opportunity on the website must create an online account.

3.2.2 Opportunities submitted via email will not be advertised, without prior discussion with the Careers and Industry Liasion team. It is the employer’s responsibility to create an account and upload their work opportunity. 

3.2.3 All opportunities must comply with current UK employment law, the Ravensbourne Agency Terms of Business and Ravensbourne's Equal Opportunities Policy.

3.2.4 All registered opportunities must include all requested information, including detailed information on your work opportunity to enable Jobseeker’s to make targeted applications. Except for work placement and internships offered as part of an academic course all registered opportunities must include an indication of the salary offered for all work opportunity except freelance opportunities where the fee may be listed as negotiable. We do advertise unpaid opportunities to students only that last no longer than 4 weeks in total. This is an accordance with the Creative Skillset guidelines. All opportunities advertised to graduates and alumni must be paid at least NMW or more.

3.2.5 We retain the right to share opportunities advertised on the Ravensbourne Agency via Ravensbourne social media channels. We will select which opportunities we share in this way and cannot guarantee that the user’s opportunity will be selected for this. 

3.2.6 When a user registers a new opportunity, it will not appear online until a trained member of the Ravensbourne staff has read the submission to ensure that the information submitted does not contravene either current UK employment law, the Ravensbourne Agency Terms & Conditions, and the Ravensbourne Equal Opportunities Policy.

3.2.7 We retain final editing rights over the information that appears on the website. We may re-word the user’s advert to ensure it does not contravene either current UK employment law, the Ravensbourne Agency Terms & Conditions or the Ravensbourne Equal Opportunities Policy.

3.2.8 Where there is any reasonable doubt over any aspect of an opportunity, we may contact the user and ask them to provide further clarity or information. If the user does not provide a response or agree to make the necessary amendments, we reserve the right not to advertise the opportunity or future opportunities from that user.

3.2.9 If an opportunity is deemed to contravene either current UK employment law, the Ravensbourne Agency Terms & Conditions or the Ravensbourne Equal Opportunities Policy, we reserve the right to not advertise the opportunity.

3.2.10 Users accept all responsibility for checking the accuracy, spelling, grammar, punctuation and overall appearance of their opportunity before submitting it for approval. 

3.2.11 Any amendments to an advert that are required once an opportunity has been approved must be made by the employer by logging back into their account and making the necessary changes. All amendments to an advert must be approved by a member of Ravensbourne staff.   

3.2.12 Opportunities will be read and approved in the order in which they are received and this can take up to 3 working days. Any amended advert will be treated as a new advert and therefore approval can take up to 3 days.

3.2.13 All opportunities are dealt with in the order in which they are received. Ravensbourne does not offer an express service for urgent opportunities or those with short deadlines. It is the responsibility of the employer to ensure that they have given sufficient time for their opportunity to be read and approved and to take this into account when stating an application deadline on the advert.

3.2.14 Ravensbourne gives no guarantee that any opportunity will appear online within 3 days of receipt. Occasionally it may take longer than 3 days for a vacancy to be approved e.g. during periods of staff annual leave, staff training, Ravensbourne events or staff sickness. 

3.2.15 The user is responsible for verifying an applicant’s identity, eligibility to work, experience, training and qualifications. Ravensbourne accepts no responsibility for a Jobseeker’s application.

3.2.16 The user is responsible for any communication and contracts that occur between them and the applicant and the University accepts no liability whatsoever thereafter.

3.2.17 Users acknowledge that Ravensbourne does not make any representation, or provide warranty, as to the suitability, honesty, character or capability of any candidate regardless of whether they are a Ravensbourne student, recent graduate or an alumni.

3.2.18 Users must comply with provisions of the Data Protection Act 1999 in relation to all applicants’ details.

3.2.19 Users accept Ravensbourne's right to visit your company to discuss your opportunities for students, recent graduates and alumni. We reserve the right not to publicise work placements, internships and vacancies from employers who are unwilling to organise/accept a visit.

3.3 Exclusions from Ravensbourne Agency

3.3.1 We do not advertise unpaid opportunities to build a portfolio e.g. designing a logo for a new company, please contact ravensbourneagency@rave.ac.uk to discuss how to proceed.

3.3.2 We do not advertise jobs that offer equity in a business as a form of payment, unless a salary above the National Minimum Wage is also offered.

3.3.3 We only advertise specific vacancies within companies - we do not advertise general calls for applicants to join a database for future potential work.

3.3.4 We do not advertise opportunities to sell work - there must be a guaranteed salary for any work produced. 

3.3.5 We do not advertise commercial internship schemes or training opportunities that might lead onto a paid position.

3.3.6 Ravensbourne does not recommend individual students or graduates for vacancies advertised through the Ravensbourne Agency service. 

3.3.7 Ravensbourne has the right to remove vacancies from the website if we have evidence that the company concerned has acted illegally in their recruitment or employment practices.

3.3.8 Ravensbourne has the right to refuse to advertise vacancies from an employer where complaints or serious concerns have been received. The nature of these complaints or concerns will remain confidential to Ravensbourne.

3.3.9 We will write to the user to inform them of our withdrawal of service and no further conversation will be entered into. After the withdrawal of service, the user’s employer account will be locked.

3.4 Voluntary work

3.4.1 Any charity who wishes to advertise via the Ravensbourne Agency should email ravensbourneagency@rave.ac.uk with the following information:
(a) Registered charity number
(b) Direct link to voluntary job vacancies page on charity’s website
(c) Web quality logo in jpg format
(d) A short paragraph about the charity and type of voluntary work on offer

3.4.2 Ravensbourne Agency reserves the right to refuse to link to any website where we feel the opportunities are not relevant to students or graduates of the Ravensbourne.

3.5 Use of the website

3.5.1 When using the website the user agrees not to do (and not to allow any person under his or her control to do) any of the following:
(a) upload or transmit any material which contains any bugs, viruses, worms, Trojan horses, or other harmful or disruptive elements; or
(b) disrupt, interfere with or restrict the use of the website by other users; or
(c) reproduce or otherwise use any part of the website in contravention of these terms and conditions; or
(d) use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the website other than any search engine and search agents available from Ravensbourne on the website and other than generally available third party web browsers (e.g. Firefox, Chrome or Microsoft Internet Explorer); or
(e) impersonate any other person or “out” any other person or create a false identity or attempt to gain unauthorised access to any part of the website including any other user’s account; or
(f) upload, transmit or display any material which:
(i) is false, obscene, sexist, homophobic, racist, defamatory, illegal, abusive, threatening, or otherwise discriminatory, offensive or objectionable; or
(ii) in Ravensbourne's opinion is likely to bring it into disrepute or otherwise damage its reputation; or
(iii) does not comply with any applicable legal, statutory and/or regulatory requirements, including any applicable codes of practice.

3.5.2 Ravensbourne reserves the right at its absolute discretion to refuse, edit or remove any material or information uploaded, transmitted or displayed by the user (or on the user's behalf) which in its opinion does not comply with the general terms and conditions or which is not otherwise suitable for the website.

3.5.3 If the user uploads, submits or posts any material on or to the website, he or she grants to Ravensbourne (and warrants that he or she is entitled to grant to Ravensbourne) a non-exclusive, worldwide, royalty-free, perpetual licence (with a right to sub-license) to use, edit, alter, reproduce, publish and distribute that content on the website for the purposes set out or contemplated in these general Terms & Conditions or on the website.

3.5.4 Should an employer wish to contact a student or graduate about a work opportunity that is not advertised through their profile on the Ravensbourne Agency then Ravensbourne Agency can take no responsibility for the nature and outcome of that contact. Employers should adhere to the details point 3.2.4 of these Terms & Conditions and should provide sufficient information to the student or graduate so that they can make an informed decision about whether or not they can complete the work.

3.6 Linking to the website

3.6.1 The user may link to the home page of the website Ravensbourne Agency provided he or she does so in a way which is fair and legal and does not damage Ravensbourne's reputation or suggest any form of association, approval or endorsement by Ravensbourne where none exists. The website from which the user is linking must not contain material which, if it appeared on the website, would be a breach of these Terms & Conditions. The user must not frame the website on any other website, or link to any part of the website other than the home page. Ravensbourne reserves the right to withdraw linking permission without notice at its discretion.

3.7 Links to other websites

3.7.1 The website may contain links to other websites which do not belong to Ravensbourne and which Ravensbourne has no control over. Therefore it accepts no liability for such other websites.

3.8 Liability to the user

3.8.1 Ravensbourne cannot guarantee that the website will always be available to the user and it shall not be liable if, for any reason the website is unavailable at any time or for any period. Ravensbourne also cannot guarantee that material which is downloaded by the user, or to which he or she has access to, from the website will be free from bugs, viruses or other harmful or disruptive elements, and Ravensbourne will not be liable for any loss or damage caused by any such material.

3.8.2 Ravensbourne shall not be liable for any delay or failures in performance on its part, in whole or in part, if such delay or non-performance is due to any cause beyond its reasonable control.

3.8.3 Ravensbourne may have little or no control over third party information and materials that may be made available to the user in certain areas of the website. Similarly, it may have little or no control over how third parties may use information and materials that the user makes available to them, directly or indirectly, on or via the website. Ravensbourne does not accept liability for any loss, damage, costs or expenses which may result from or arise out of the user’s use of or reliance upon third party information and material, or any use by third parties of the user’s information and materials.

3.8.4 Where any of the information, materials or services which the Ravensbourne provides on or in connection with the website are made available to the user free of charge, Ravensbourne does not accept any liability whatsoever for the information, materials and services in question, which are provided to the user on an “as is” and “as available” basis.

3.8.5 Whilst Ravensbourne takes all reasonable care when making its own information, materials and services available to the user, Ravensbourne makes no promises as to their accuracy, completeness or quality. The user makes use of them (and of the other information, materials and services on the website) at his or her own risk and the user should seek further guidance and make his or her own inquiries before relying on them. In no circumstances shall Ravensbourne be liable to the user, whether in contract, tort, negligence, breach of statutory duty or otherwise, for any direct, indirect, consequential or other types of loss, costs, damages or expenses, arising out of or resulting from his or her use of (or inability to use) the website, any materials posted on the website and any websites linked to the website.

3.8.6 In no circumstances shall Ravensbourne be liable to the user, whether in contract, tort, negligence, breach of statutory duty or otherwise, for any loss of data, loss of management or office time, loss of income or revenue, loss of profits or contracts, loss of business, or for any special, indirect or consequential loss, costs, damages or expenses, arising out of or resulting from the user's use of (or inability to use) the website, any materials posted on the website and any services purchased from or in connection with the website.

3.8.7 All warranties, conditions and other terms which might otherwise be implied by statute, common law or the law of equity are, to the fullest extent permitted by law, excluded from these Terms & Conditions.

3.8.8 Nothing in these Terms & Conditions shall exclude or limit Ravensbourne's liability to the user for death or personal injury resulting from its negligence, fraud or fraudulent misrepresentation.

3.9 Copyright

3.9.1 Ravensbourne owns or is licensed to use all the copyright and other intellectual property rights in the website and in the materials on the website.

3.10 Privacy policy

3.10.1 Ravensbourne is committed to respecting and protecting the privacy of the users of the website. For the purposes of the Data Protection Act 1998 (the "DPA”), Ravensbourne is the data controller for the website, as it has control over and responsibility for the personally identifiable information (the “Personal Data”) that it collects from each user, or which is provided to Ravensbourne by the user. Ravensbourne complies with the data protection principles set out in the DPA and processes all personal data with due care and attention and in accordance with the DPA.

3.10.2 By agreeing to the Terms & Conditions for use of the website, the user also consents to Ravensbourne using the user's personal data in accordance with this Privacy Policy.

3.10.3 When the user uses the website, Ravensbourne may collect and process the following Personal Data:
(a) information that the User provided during the course of registration via the website;
(b) records of any correspondence between Ravensbourne and the user;
(c) details of the user's visits to the website and the resources that the user accesses; and
(d) details of any transactions the user carries out through the website and of the fulfilment of your orders (i.e. details of work opportunities and internships submitted).

3.10.4 Ravensbourne may use the user's personal data:
(a) to verify the user's identity;
(b) to ensure that material on the website is presented in the most effective manner for the user and the user's computer;
(c) to provide the user with information, materials and services that the user requests from Ravensbourne or which Ravensbourne believes may be of interest to the user.
(d) to meet any obligations Ravensbourne may have to the user;
(e) to allow the user to participate in interactive features of the website;
(f) to communicate with the user on any matter relating to the website; and
(g) for various administrative functions connected with the website.

3.10.5 Upon registering as an employer the user will be added to the Ravensbourne Agency mailing list. This is a monthly newsletter and the user may un-subscribe from this by clocking the ‘Unsubscribe’ link on the newsletter. Ravensbourne Agency will also email all users about updates to the Ravensbourne Agency when relevant.


3.10.6 Ravensbourne may use “cookies” to help obtain information about the user's use of the website. Cookies are files containing information that are transferred from the website to the hard drive of the user's computer. They help Ravensbourne to improve the website and to provide the user with a more personalised service. For example, cookies may be used to recognise the user's computer by its IP address, operating system and browser type, so that the next time the user visits the website Ravensbourne knows that the user is a repeat visitor. It is normally possible to alter the settings of the user's computer so that cookies cannot be used in this way, but this may affect the way in which the user can use the website.

3.10.7 The Personal Data collected via the website is stored on servers in the United Kingdom. It may be processed by Ravesnbourne staff and/or by Ravensbourne's nominated contractors (and by the staff of these contactors). Ravensbourne will take all reasonable steps necessary to ensure that Personal Data is treated securely and in accordance with this paragraph 3.8.

3.10.8 Ravensbourne may also collect and analyse Personal Data to help Ravensbourne understand the website's users (as a group) so that it can provide a better service. Ravensbourne may share aggregated data with selected third parties, without disclosing individual names or personally identifying information.

3.10.9 Ravensbourne may disclose Personal Data to its officers, employees, consultants and agents, and to any of its subsidiary companies.

3.10.10 Ravensbourne may also disclose Personal Data to (other) third parties where it is under a duty to do so in order to comply with any legal obligation, or in order to enforce or apply its Terms & Conditions and other agreements (including in order to fulfil its contractual obligations to other users of the website), or to protect its rights, property or safety, or those of others. This includes exchanging information with other companies and organisations for the purposes of fraud prevention and credit risk reduction.

3.10.11 Where the user has registered an email address, postal address or telephone number as part of the registration process to create an employer accont, these details will always be kept private and will not be sold or given to any third party member outside of Ravensbourne staff.

3.10.12 Where the user has stated an email address, postal address or telephone number as an application method for Jobseekers this information will appear in the public domain online and Ravensbourne accepts no responsibility for subsequent third party use of these contact details. 

3.11 Breach of these terms and conditions and the user's indemnity to the University

3.11.1 If the user is in breach of any of these Terms & Conditions, Ravensbourne may take the following action (without limitation) against the user:
(a) the immediate suspension or cancellation of the user's right to use the website;
(b) the immediate removal of any material the user has uploaded onto the website;
(c) legal proceedings against the user;
(d) disciplinary proceedings against the user (if the user is one of Ravensbourne students or graduates); and/or
(e) disclosure of such information about the user to law enforcement authorities as is required by law or as Ravensbourne reasonably believe is desirable.

3.11.2 The user agrees to indemnify Ravensbourne and keep it fully indemnified from and against all costs, expenses (including reasonable legal expenses), damages and losses arising out of any breach by the user of these Terms & Conditions.

3.12 Changes to these Terms & Conditions

3.12.1 Ravensbourne may change these Terms & Conditions from time to time. Any changes will be displayed on the website. The user is deemed to have agreed to any changes when the user next uses the website following any such changes.

4. Client user-generated content: Interlectual property rights

4.1.1 Your user-Generated Content remains your sole intellectual property and copyright and Ravensbourne Agency makes no claim of ownership rights.

4.1.2 The Ravensbourne Agency requires a licence from you to allow us to publish your content on the Internet, this licence is worldwide. This licence is non-exclusive allowing you to licence your content to all others. This licence is royalty-free, Ravensbourne Agency is not required to pay you for the publishing of your content. This licence is sub-licensable in order to allow us to deliver your Content electronically, via subcontractors such as Internet delivery networks. You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to us the right to sub-license these rights, and the right to bring an action for infringement of these rights.

5. Governing law

5.1 These Terms & Conditions (including without limitation non-contractual disputes or claims relating to them) shall be governed by and construed in accordance with English law and the English courts shall have exclusive jurisdiction to determine any matter or dispute in connection with these Terms & Conditions or the use of the website.
